Official Contest Rules

CONSUMER DISCLOSURE: NO MEMBERSHIP, PURCHASE, OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST.

“The Partners” means Catalog Choice.org and The Overbrook Foundation.

ENTRY IN THIS CONTEST CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES.

The Paperless Choice Challenge (the “Contest”) is a skill contest where nonprofit organizations must submit information and appropriate supporting documentation presenting a digital fundraising campaign (the “Campaign”). For the purposes of these Official Rules, a “Nonprofit” is any entity that (a) is a 501(c)3 organization or (b) operates in collaboration with a 501(c)3 fiscal sponsor. The fundraising campaigns will be evaluated by judges who will choose a winner in four categories.

1.    Binding Agreement: In order to enter the Contest, you must agree to these Official Rules (“Rules”). Therefore, please read these Rules prior to entry to ensure you understand and agree. You agree that submission of an entry in the Contest constitutes agreement to these Rules. You may not submit an entry to the Contest and are not eligible to receive the prizes described in these Rules unless you agree to these Rules. These Rules form a binding legal agreement between you and Catalog Choice with respect to the Contest.

2.    Agreement to Rules: By entering this contest, you agree to all of these Official Rules. All decisions regarding the contest will be made by “The Partners” in its sole discretion, and are final.

3.    Eligibility: This contest is open only to nonprofit organizations and not for-profit ventures. Not valid where prohibited. Employees, officers or directors of “The Partners” are not eligible.

4.    Originality and Rights: By submitting information and supporting documentation about your Campaign, you are promising that you own all rights to all material in your entry. Organizations submitting entries will retain all rights to those entries.

5.    Judging: Each entry will be judged by a panel of experts who are designated by the Paperless Choice Challenge (“Judges”). Beginning on or about September 15, 2010, submissions will be evaluated by the Judges based on the following criteria:

30% Successful ROI/Measurability of results.
Was the campaign ROI measurable and did it meet or exceed fundraising goals?

30% Ease of replication
Was the success of this campaign due to a one-time viral fluke, or can the campaign be modified and replicated for ongoing fundraising results?

30% Ability to act as a replacement for postal mailings
How did the campaign effect your organization’s mix of paper versus digital fundraising efforts? Can the campaign replace direct mail efforts?

10% Inventiveness and originality
What elements of your campaign made it stand out?

Judges will evaluate and attribute a rating to each Campaign presentation made up of scores based upon the above-listed criteria. The top entry in each category will be selected as “Winners.” The People’s Choice prize will go to the campaign with the most votes. In the event a potential Winner is disqualified for any reason, the campaign presentation that received the next highest total score will be chosen as the potential Winner. The Partners may, in its sole discretion, contact any or all of the potential Winners via the email addresses submitted on the entry form in order to confirm the eligibility of those potential Winners and compliance with the Official Rules.

If a Judge has a professional affiliation with the organization that created a particular Campaign, that Judge will recuse himself or herself from rating that Campaign.  The Campaign and organization will not be affected either positively or negatively in the Judging process.

6.    Categories: An organization will submit an entry in 1 of 3 categories. The Categories for The Paperless Choice Challenge are based on the size of each organization’s budget.  Judges reserve the right to modify category definitions based on contest distribution.

The Small Organization category includes organizations with an annual budget of $1,000,000 or less.

The Medium Organization category includes organizations with an annual budget of $1,000,000 to $5,000,000.

The Large Organization category includes organizations with an annual budget of
$5,000,000 or more.

7.    SELECTION OF WINNERS:

Submissions will be judged by a qualified panel of judges (“Judges”) who will evaluate each eligible Submission based on the judging criteria. The top entry in each category will be designated as the  Winner. In addition to the prizes awarded in the three categories determined by organization budget, the Judges will award a People’s Choice Winner determined by the number of votes received. This category will be judged across all entries in all three size categories. Judging will be completed on or about October 15, 2010.

All Winners are subject to verification, including without limitation, verification of eligibility, compliance with these Official Rules and completion of all required documents (described below). Entrants agree that “The Partners” have the sole right to decide all matters and disputes arising from this Contest and that all decisions of “The Partners” are final and binding. Catalog Choice reserves the right to disqualify a contest submission at its discretion.

8.    To Enter the Contest: The contest Submission Period starts June 1, 2010 at 12:01 am EDT and ends at 11:59 pm EDT on September 15, 2010.

You will receive a confirmation email from Catalogchoice.org.

9.    Prizes: “The Partners” will award one $5,000 prize in each size category and one $5,000 prize to the People’s Choice winner which will go to the idea with the most votes.

Failure to respond to the information requests or otherwise timely comply with all rules or requests from “The Partners” will void the award, and the prize may then be awarded to another entrant.

10.    CHOICE OF LAW AND RECOURSE TO JUDICIAL PROCEDURES: These Rules shall be governed by, subject to, and construed in accordance with the laws of the State of California, United States of America, excluding all conflict of law rules. If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. To the extent permitted by law, the rights to litigate, seek injunctive relief or make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded, and all participants expressly waive any and all such rights.

11.    Additional Conditions and Terms: As a condition for entry, you agree to release, waive, indemnify, and otherwise hold harmless “The Partners” and all persons associated with it from any liability associated with your video and this contest to the fullest extent of appropriate state or local laws.

(A) All taxes are the responsibility of the winner.
(B) You agree to comply with all government laws and regulations.
(C) ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, “The Partners” RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
(D)”The Partners” are not responsible for errors of any kind, technical hardware or software failures of any kind, including any injury or damage to any person’s computer, related to or resulting from participating in or experiencing any materials in connection with the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit your ability to participate in the promotion.
(E) “The Partners” reserve the right to cancel or modify the contest if fraud, misconduct or technical failures harm the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration or security of the program as determined by “The Partners”, in their sole discretion. In the event of termination, a notice will be posted online. If insufficient entries are received, or if no entry submitted meets minimum reasonable criteria for a prize, in “The Partners” sole and final discretion, a winner in each category may not be selected. If at least one qualifying entry is made, at least one finalist award will be made.
(F) Proof of submitting entries or responses to inquiries will not be deemed to be proof of receipt by “The Partners”. Only receipt of an e-mail from “Catalogchoice.org” acknowledging an entry or communication will be considered proof of submission.
(G) Any use of robotic, automatic, programmed or like methods of participation will void all such submissions by the entrant.
(H) “The Partners” reserve the right to prohibit the participation of an individual if fraud or tampering is suspected or if the account holder fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.
(I) Once submitted, an entry is final and may not be altered or edited further. Duplicate entries will disqualify all such entries.
(J) No submissions will be returned.
(K) “The Partners” may use any and all information obtained from entrants for its internal activities, including contacting an entrant. “The Partners” may share this information with others, but will not sell this information to others.
(L) This Contest is offered only in the United States and is governed by the laws of the State of California. All claims relating in any manner to this contest or to any submission must be resolved in the federal or state courts of Alameda County, California. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of participants and “The Partners” in connection with the contest, shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of California.
(M) “The Partners” are not responsible for any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user’s own risk.
(N) The odds of winning will be determined by the number of entries.
(O) Project may be executed and submitted by an individual or a group – for communications purposes, please identify one person as the team representative and note on the entry form.
